Mad magazine was sued in 1965 by a womam claiming that her late husband, Harry Spencer Stuff created the drawing in 1914. The character had been copyrighted. However, Mad claimed that the character was in the public domain because 1) Pratt didn't really create the character, as it had been seen in advertising from as early as 1895, and 2) Stuff's widow never really protected the copyright. The case actually went before the Supreme Court, and Mad won.
