The Astros would have been completely within their rights to request a pre-draft physical. The CBA states that this can be done and the only requirement is that Aiken provide the findings with all other teams that request it. He cannot, for example, provide extra medical information to the Astros yet withhold it from the Mets. So, from what I can see, the Astros could have requested Aiken get a pre-draft physical and did not because they thought his physical state was fine due to his limited usage in HS and his crossfit routine. Aiken could have refused to get the physical but then the Astros could have refused to draft him. As far as I can tell this IS an issue with the Astros not doing their due diligence and the radio comment was spot on.
